Terms of Service

1. Acceptance & Who We Are

GraviTalk (the “App”) is operated by Splash Consulting Partners LLC (“we,” “our,” or “us”), a limited liability company organised in the United States. By creating an account or using GraviTalk, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the App.

2. What GraviTalk Is

GraviTalk is a private practice space for spoken communication. You record practice sessions on your own device; the App transcribes them locally and our AI generates coaching feedback on your Substance, Language, and Delivery. Scores and coaching are informational feedback to support your own practice — they are not professional, medical, or career advice, and no particular outcome is promised. 3. Accounts & Eligibility

• You must be 18 years of age or older to create an account, as confirmed during sign-up.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• You agree to provide a valid email address; we use it as described in the Privacy Policy.
• One account per person. Accounts may not be shared, sold, or transferred.

4. Subscriptions, Trials & Billing

• Paid plans are billed through Google Play using the payment method on your Google account. Prices are shown in the App and on Google Play before you subscribe, and may vary by country.
• New subscribers may be offered a 3-day free trial. One free trial per person, ever — including across deleted and re-created accounts. Unless you cancel before the trial ends, your subscription starts automatically and the plan price is charged.
• Subscriptions renew automatically (monthly or annually, per your plan) until cancelled. Cancel any time in Google Play → Subscriptions; cancellation takes effect at the end of the current billing period. Refunds are governed by Google Play’s refund policies.
• If a subscription price changes, you will be notified in accordance with Google Play’s policies before the change applies to you.
• Deleting your account does not automatically cancel a Google Play subscription — see the Privacy Policy, Section 8a.

5. Fair Use

To keep GraviTalk fast and fair for everyone, practice sessions are subject to a fair-use ceiling of 15 analyzed sessions per day. The counter resets at midnight in your local timezone.

6. Acceptable Use

You agree not to:

• Record any person other than yourself without their consent, or otherwise use the App in violation of applicable law;
• Attempt to probe, disrupt, reverse-engineer, or gain unauthorised access to the App, our servers, or other users’ data;
• Use automated means to access the App, or use the App to develop a competing service;
• Submit content that is unlawful or infringes the rights of others.

7. Your Content & Our Intellectual Property

• Your sessions remain yours. You retain all rights to your transcripts. You grant us a limited licence to process and store them solely to operate the service — to generate your coaching and show you your history — as described in the Privacy Policy. We do not use your transcripts to train AI models.
• The App, its design, branding, coaching frameworks, and all related materials are the property of Splash Consulting Partners LLC and are protected by intellectual-property laws. No rights are granted except as needed to use the App as intended.

8. Disclaimers & Limitation of Liability

The App is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we do not warrant that the App will be uninterrupted or error-free. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the App is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

9. Termination

You may stop using GraviTalk and delete your account at any time (see Delete Your Account). We may suspend or terminate accounts that violate these terms, with notice where practicable. Sections 7–11 survive termination.

10. Changes to These Terms

We may update these terms from time to time. When we do, we will update the “Last Updated” date above and notify you via the App or by email if the changes are material. Continued use after changes are posted constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Minnesota, and you consent to their jurisdiction.

Common Questions

Is there a limit to how many sessions I can run?

Yes — up to 15 analyzed sessions per day under our fair-use policy, which applies to all plans including Pro. The limit resets at midnight local time. Hitting the ceiling doesn’t affect your subscription; you can practice again the next day.
